Birmingham City Council’s Sexual Entertainment Venue Policy became effective from 1st November 2014.
1.2 Applications have been received which seek to transfer the Sexual Entertainment Venue (SEV), Sex Shop and Sex Cinema licences granted to Sunset Novelties Limited to Coventry Road Lingerie Limited in respect of premises known as AdultWorld, 1 Hinckley Street, Birmingham B5 4EB. Officers do not have delegated authority to approve the transfer applications which must be determined by the Committee in accordance with the current scheme of delegations.
1.3 Simultaneous applications have also been submitted for the renewal of the Sex Shop and Sex Cinema licences. In the absence of any observations or objections, and or any reason to refuse the renewal in accordance with Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 officers have delegated authority to renew those licences.
1.4 There are no objections to either the transfer or renewal applications.
1.5 Subject to the Committee approving all three transfer applications the Sex Shop and Sex Cinema licences will be renewed by officers under delegated authority.
1.6 At the time of writing this report an application to renew the existing Sexual Entertainment Venue licence had not been submitted as the licence is not due to expire until 22 July 2019.
1.7 In respect of the SEV transfer application officers can confirm that there are currently 7 SEV venues licensed to operating within Birmingham 6 of which, including this premises, are located within the area bounded by the ring road (A4540).
1.8 As stated in Birmingham City Council’s SEV Policy the Council considers that the part of the City which falls within the ring road (A4540) is an area which is appropriate to have an upper limit guide on the number of SEV’s the appropriate upper limit being eight.
