On 16 December 2025, Cabinet
Committee – Property:-
(i) Declared surplus to the Council’s
requirements and approved the freehold disposal of the site shown edged red on
the plan in Appendix 1 to the report;
(iii) Delegated the Executive Director for
Place Prosperity & Sustainability in consultation with the Executive
Director of City Housing the power to give notice, where required, of any
proposed disposal, and to consider any objections made, pursuant to Section 123(2A)
of the Local Government Act 1972;
(iii) Noted the land asset has been identified
for sale from the Housing Revenue Account (HRA) to provide affordable housing.
The receipt will be paid into the HRA;
(iv) Delegated authority to the Executive
Director for Place, Prosperity, and Sustainability (or their delegate) in
consultation with the Executive Director of City Housing, the Director of
Finance (s151 Officer), (or their delegate), and the City Solicitor (Monitoring
Officer) (or their delegate) to approve the final terms of the Sale Agreements.
These will be based within the parameters set out within the Best Consideration
Report in Exempt Appendix 3 to the report;
(v) Noted that the purchaser will engage with
the local community and Ward members via the planning approval process. Ward
members have been notified of the sale of site within their ward for the
development of affordable housing;
(vi) Noted the appointment of external
solicitors and authorised the City Solicitor (Monitoring Officer) to approve,
execute, and complete all relevant legal documentation to give effect to the
above;
and
(vii) Noted the Council have a Nominations
Agreement in place with a number of Registered Providers which entitles the
Council to nominate tenants into the new homes. Whilst a Registered Provider
has not yet been identified it is anticipated the Council will be able to
nominate from it’s housing register. The land will be sold with a restriction
for affordable housing and a sales anti-embarrassment clause.
