Decision Outcome
That the revised application by Birmingham Hippodrome Theatre Trust for a time limited premises licence on 8th and 9th July 2016 in respect of Furious Folly, Battle Of The Somme Anniversary, Sutton Park, Upper And Lower Arena Fields, Map Ref: SP 09655 97436, Sutton Coldfield B73 BE GRANTED. Those matters detailed in the operating schedule and the relevant mandatory conditions under the Licensing Act 2003 will form part of the licence issued together with those conditions as volunteered by the applicant as follows: I. Members of the Safety Advisory Group (SAG) responsible for the event taking place, must meet regularly in advance of the event on the 8th & 9th July 2016, as set out in the application; II. All reasonable recommendations of the SAG relating to the event must be implemented in advance of the event. Members carefully considered the representations made by other persons but were not convinced that there was an evidential and causal link between the issues raised and the effect on the Licensing Objectives. Members of the Sub-Committee were informed that no Responsible Authority has made any representation against the Grant of the Licence– particularly; WM Police, the Fire Authority, nor the City Council Environmental Health Department. Members were persuaded on the balance of probabilities that having considered how the event would be managed in accordance with the submitted, “Event Manual” they were satisfied that the applicant would properly promote the Licensing Objectives and negate the matters those making representations had raised. Furthermore they felt that the reasonable recommendations from SAG would properly address any concerns raised by those making representations. The Sub-Committee encouraged the applicant to try and meet with those making representations to allay their fears over the proposed event. The Sub Committee deliberated the operating schedule put forward by the applicant and the likely impact of the application, including the agreed conditions and concluded that by granting this application, the four Licensing Objectives contained in the Act will be properly promoted. In reaching this decision, the Sub-Committee has given due consideration to the City Council’s Statement of Licensing Policy, the Guidance issued under Section 182 of the Licensing Act 2003 by the Secretary of State, the application for a revised time-limited premises licence, the written representations received and the submissions made at the hearing by the applicant and their legal adviser. All parties are reminded that under the provisions contained within Schedule 5 to the Licensing Act 2003, there is the right of appeal against the decision of the Licensing Authority to the Magistrates’ Court, such an appeal to be made within twenty-one days of the date of notification of the decision.
