On 18 August 2025, Cabinet Committee – Property:-
(i) Noted the Pre Decision Scrutiny undertaken by the Economy, Skills and Culture Overview and Scrutiny Committee on 16 July 2025, and considers its recommendation seeking assurances that, if agreed, wider community use of this sporting facility will be explored by the Council with the purchaser;
(ii) Authorised the Assistant Director of Corporate Landlord to accept the bid of the preferred purchaser recommended in Exempt Appendix 2 to the report;
(iii) Further authorised the Assistant Director of Corporate Landlord to accept the bid and conclude the terms with the preferred purchaser for a freehold sale on the Council owned asset, the former Coleshill Road Garden Nursery site, Coleshill Road, Sutton Coldfield, B75 7BA (“the Property”). The property is shown edged bold black on the attached site plan at Appendix 1 to the report and extends to 2.75 acres (1.1 hectares). See detailed information in Exempt Appendices 2, 3 and 4 to the report;
(iv) Noted that the purchaser will pay a contribution towards the Council’s surveyor and legal costs, as detailed in Exempt Appendix 3 to the report;
(v) Authorised the Assistant Director of Corporate Landlord to revert to the other bidders in the event of a failure to complete the transaction within the prescribed timeline and conclude a sale to an underbidder on the best available terms subject to the Council’s duties under Section 123 of the Local Government Act 1972;
(vi) Authorised the City Solicitor to prepare, negotiate, execute, and complete all relevant legal documentation to give effect to the above.
