Decision Outcome

On 30 June 2025, Cabinet Committee – Property:-

 

  1. Declared surplus to the Council’s requirements and approved the freehold disposal of sites listed below and as detailed with red line plans in Appendix 1, to the report;

     

  2. Delegated to the Executive Director for Place Prosperity & Sustainability in consultation with the Executive Director of City Housing the power to give notice, where required, of any proposed disposal, and to consider any objections made, pursuant to Section 123(2A) of the Local Government Act 1972;

     

  3. Noted the land assets have been identified for sale from the Housing Revenue Account (HRA) to provide affordable housing with the Council retaining Nomination Rights for those on its housing register. The receipts will be paid into the HRA;

     

  4. Delegated authority to the Executive Director for Place, Prosperity, and Sustainability (or their delegate) in consultation with the Executive Director of City Housing, the Director of Finance (s151 Officer), (or their delegate), and the City Solicitor & Monitoring Officer (or their delegate) to approve the final terms of the Sale Agreements. These will be based within the parameters set out within the Best Consideration Report in Appendix 3, to the report;

     

  5. Noted that the purchasers will engage with the local community and Ward members via the planning approval process. Two of the sites already have planning consent. Ward members have been notified of the sale of site within their ward for the development of affordable housing;

     

  6. Noted the appointment of external solicitors and authorised them and the City Solicitor and Monitoring Officer to prepare, execute, and complete all relevant legal documentation to give effect to the above decisions;

     

  7. Noted the contractors and their Registered Provider partners have been selected after a competitive procurement process with an invitation to tender sent to over fifty parties;

     

  8. Noted the Council have a Nominations Agreement in place with the Registered Providers which entitles the Council to nominate tenants into the new homes. As part of the tender process, RPs have responded in being able to extend the 100% for subsequent lets within the first ten years.
