Purpose

Birmingham City Council’s Regulation and Enforcement Division is consulting on the proposal to introduce a Public Space Protection Order (PSPO) for certain streets and areas in the city centre. This is to address anti-social behaviour in respect of street trading of goods and/or services, peddling goods and/or services, distribution of publicity materials/free literature/samples, charity or commercial subscription collection, charity cash or digital collections and obstruction of the highway. The purpose of this report is to provide feedback on the public consultation exercise that has been undertaken as part of the consideration process for the PSPO and make recommendations as to whether or not a PSPO should be declared.

Reason For Key Decision

Counsel advice was sought on 20th January 2025 on whether or not a PSPO in one ward in the City Centre could be considered a key decision on the basis of its effect on people of numerous wards as it concerns activities in the city centre. Counsel’s advice is, if the Council wished to consider this as a key decision that would be acceptable as the city centre attracts visitors from all over the city.

On 22 July 2025 Cabinet:-

(i)   Noted this report and the outcome of the public consultation; and

(ii)   Approved the introduction of the new Public Spaces Protection Order (PSPO)                     covering illegal street trading, peddling, unauthorised distribution of materials and               collections, and obstruction for the city centre found at Appendix A to the report.
