Inclusive Growth

On 22 May 2019, Cabinet :- 

1. Approved  the Director, Inclusive Growth and the Chief Finance Office in consultation with the Cabinet Members for Transport & Environment and Finance & Resources, to continue to negotiate a settlement in respect of all disputes under the Highway Maintenance and Management PFI contract in accordance with the settlement criteria set out in Appendix C (Exempt Appendix - C1) to the report;

    

2. Confirmed its intention to conclude a deal (in accordance with the criteria set out in Appendix C (Private Appendix - C1)) to the report, within the shortest possible period and notes that a further report will be to brought to Cabinet no later than 25th June 2019 setting out the proposed final terms of the settlement agreement;

    

3. Delegated authority to the Assistant Director, Highways and Infrastructure, to commence the negotiation of commercial terms with Amey Birmingham Highways Ltd (the SPV) relating to its procurement of a replacement Operating Subcontractor, to be subject to approval under a further report to Cabinet and the approval of the Department for Transport;

    

4. Noted the information contained within Exempt Appendix – C to the report, regarding the Council’s commercial position to support the above decisions.
