Decision Details

Cabinet approved the procurement strategy for the building improvement works at the Dolphin Centre in Ward End Park on 22^nd March 2022. The procurement process was undertaken with one compliant tender received which was significantly over budget. To enable the project to continue, the following recommendations are required:

• To approve the award of a contract to the supplier with the compliant tender for the building improvement works at the Dolphin Centre in Ward End Park following conclusion of the amended procurement process using the Negotiated Procedure.

• In the event of failing to conclude the recommendation above, to approve  the amended procurement strategy to use Acivico Ltd’s Constructing West Midlands 2 Framework Agreement or another compliant framework agreement in accordance with its rules and delegate the award of a contract to the Managing Director, City Operations in conjunction with the Assistant Director, Procurement (or their delegate), the Director, Council Management (or their delegate) and the City Solicitor & Monitoring Officer (or their delegate).

• Approves the additional allocation of a further £xxx in the capital programme for the Dolphin Centre Building Improvement Works.

3. Information relating to the financial or business affairs of any particular person (including the council)

On 28 June 2022, Cabinet:-

(i)       Approved the additional allocation of £555,700 from the capital programme for the building improvement works at the Dolphin Centre in Ward End Park;

(ii)      approved the award of a contract to Building Services Now Ltd for the building improvement works at the Dolphin Centre in Ward End Park for a construction period of 40 weeks as detailed in Appendix A to the report;

(ii)      noted the amendment to the procurement strategy approved by Cabinet dated 22 March 2022 for the reasons detailed in Appendix A to the report;

(iv)     in the event of recommendation (ii) above not being approved, the alternative procurement strategy as noted in 7.4 of the report is to use Acivico Ltd’s Constructing West Midlands 2 Framework Agreement or another compliant framework agreement in accordance with its rules and delegate the award of a contract to the Strategic Director of City Operations in conjunction with the Assistant Director, Procurement (or their delegate), the Director, Council Management (or their delegate) and the City Solicitor & Monitoring Officer (or their delegate);

(v)      authorised the City Solicitor and Monitoring Officer to negotiate, execute and seal and complete all necessary documentation to give effect to the above recommendations
