Purpose
The continued review of the Council’s land and property portfolio has identified the individual property interests surplus to requirements. It is proposed that these property interests form part of an agreed programme of land and property sales to be implemented during financial years 2025/26 and 2026/27, contributing to the Council’s Financial Recovery Plan.

Decision Outcome

On 23 September 2025, Cabinet Committee – Property:-

 

(i)  Declared (that with the exception of the property listed as Land fronting Watton Green/Padgate Close), the land and property assets listed in Appendix A, to the report, surplus to Council requirements and authorises their subsequent sale as detailed;

 

(ii)  Noted that in accordance with existing surplus property procedures no internal reuse of the properties listed in Appendix A, to the report, has been identified;

 

(iii)  Authorised the Executive Director, Place Prosperity & Sustainability to conclude the sale of the Council’s property interests at public auction (where auction is indicated as the method of disposal) through its appointed auctioneers during 2025 and 2026;

 

(iv)  Authorised the Executive Director, Place Prosperity & Sustainability, where deemed appropriate, to set individual reserve prices in excess of £200,000;

 

(v)  Noted that currently, the Assistant Director, Corporate Landlord has authority to dispose of individual properties (using the sale options recommended in this report), at a value of up to £200,000;

 

(vi)  Delegated authority to the Assistant Director, Corporate Landlord, in conjunction with the Executive Director, Place Prosperity and Sustainability and the Deputy Leader, to agree terms for and conclude sales of properties of those assets identified in this report with a disposal value between £200,000 and £2m;

 

(vii)  Noted that transactions outside this range or not utilizing this delegation set out in paragraph (vi) above will be reported to a future Cabinet Committee Property meeting for a decision;

 

(viii)  Authorised the City Solicitor, where necessary, to advertise the permanent loss of public open space and consider any objections in accordance with Section 123(2A) of the Local Government Act 1972;

 

(ix)  Authorised the City Solicitor to negotiate, execute and complete all necessary legal documents to give effect to the above decisions.

 

THE DEADLINE FOR CALL IN IS 1600 HOURS ON MONDAY 29 SEPTEMBER 2025.

 

On the 29 September 2025 at 1417 hours, a request for call-in was submitted by Councillors Sam Forsyth and Martin Brooks.  No action can be taken to implement the above decision until the request for call-in has been approved by the Director of Law and Governance (Monitoring Officer), in consultation with the Chair of Corporate and Finance Overview and Scrutiny Committee.  If approved, the decision will then be considered by the relevant Overview and Scrutiny Committee within 15 days of the decision being posted.
