Decision Outcome
It has come to the attention of the Licensing Sub-Committee at a late stage this morning that there has been a disclosure of sensitive personal data in this matter.
West Midlands Police and Birmingham City Council are taking the appropriate steps to deal with this potential breach of the Data Protection Act 1998, via each organisation’s internal procedures.
On behalf of Birmingham City Council, we confirm that officers have stated that all papers submitted by West Midlands Police have been removed from the Council’s CMIS website, as of 10am this morning.
In the meantime, members of the Sub-Committee have taken legal advice this morning, and has resolved to adjourn this meeting, in the public interest in accordance with Regulations 11,12,13 of the Licensing Act 2003 (Hearings Regulations) 2005.
Consequently, this meeting will now be adjourned to Wednesday the 17th August 2016, in Committee Room 1, the Council House, Victoria Sqaure, Birmingham, B1 1BB, with a start time of 12.30pm.
In order to observe the spirit of the Data Protection Act 1998, we recommend that the Police now ask all parties to now hand back the supplementary papers served on them, to PC Deano Walker, on the basis that a revised version (which is compliant with the provisions of the Data Protection Act 1998) will be submitted by the Police and thereafter served on all parties in advance of the adjourned hearing.
One set of papers already served by West Midlands Police, will be retained by the Committee Lawyer, for the purposes of reporting the matter to the Council’s Corporate Information Manager later today.
