Purpose
This report seeks approval to purchase or acquire, either through negotiation or compulsorily, privately owned properties identified in the Private Report. The properties have been empty for a very long time, thereby having a negative impact on local residents and communities. They also reduce the supply of sustainable housing at a time of housing crisis

Decision Outcome

On 9 December 2025 Cabinet:-

(i)    Authorised the Executive Director of Place, Prosperity and Sustainability to negotiate terms of the acquisition of the properties listed in the Private Report either voluntarily or through use of a Compulsory Purchase Order (CPO) if required including appropriate compensation;

(ii)   Authorised the Executive Director of City Operations to incur expenditure for the potential acquisition of properties up to a total value of £3.319m from the Empty Homes capital receipts budgets, with subsequent capital receipts being recycled within this programme;

(iii)  Authorised the City Solicitor (Monitoring Officer), where instructed by the Executive Director of City Operations, to make a Compulsory Purchase Order (CPO) or CPOs under Section 17 of the Housing Act 1985 for acquisition of the properties listed in the Private Report in order to bring these properties back into use.

(iv)  Authorised withdrawal of the properties from the CPO in the event that, after making the CPO, the properties are improved and re-occupied to the satisfaction of the Executive Director of City Operations;

(v)   Following any acquisition of properties listed in the Private Report, authorised the Executive Director, Place Prosperity and Sustainability to instruct the Property Sales Manager to either dispose of each property on the open market on a leasehold basis or to a registered provider with a condition that it is improved and reoccupied within 12 months to the satisfaction of the Executive Director of City Operations or to retain the properties for council housing stock if considered strategically appropriate;

(vi)  Authorised the City Solicitor (Monitoring Officer) to negotiate, execute and complete any documents required to give effect to the decisions in the report; and

(vii) Authorised the City Solicitor (Monitoring Officer) if granted power to do so by the Secretary of State for Ministry of Housing, Communities and Local Government to Confirm the Compulsory Purchase Order.
