Purpose
To report the requirement to seek an in-year variation to the Birmingham admission arrangements to ensure compliance with the new 2021 School Admissions Code (the Code), which requires children who appear (to the admission authority) to have been in state care outside of England and ceased to be in state care as a result of being adopted to be given equal first priority in admission arrangements, alongside looked after children (LAC) and children who were previously looked after by English local authorities (PLAC). This advice refers to these children as internationally adopted previously looked after children – “IAPLAC”.

On 27 July 2021, Cabinet:-

 

  1. Approved the varied admission arrangements for community and voluntary controlled schools for the academic year 2021/2022 and 2022/2023, as set out in Appendix 1A and 1B to the report;

     

  2. Approved the varied Co-ordinated Scheme for the academic year 2021/2022 and 2022/2023, as set out in Appendix 2A and 2B to the report;

     

  3. Noted the changes made to Birmingham’s Fair Access Protocol by way of an addendum, identifying the legal requirements of the new Code as they pertain to Fair Access and set out in Appendix 3 to the report and the intention to consult on these and further changes with schools.

     

  4. Approved the delegation of authority to the Cabinet Member for Education Skills and Culture to develop in consultation with the Director of Education and Skills a new draft Fair Access Protocol following consultation with schools and prior to seeking formal sign off from schools.
